企業可以“逆(ni)向(xiang)派(pai)(pai)遣(qian)(qian)(qian)”嗎?實(shi)踐(jian)中,很多企業已(yi)經與勞(lao)(lao)動(dong)者(zhe)簽(qian)訂(ding)了(le)勞(lao)(lao)動(dong)合(he)同或者(zhe)存在事實(shi)勞(lao)(lao)動(dong)關(guan)系,卻找來勞(lao)(lao)務(wu)派(pai)(pai)遣(qian)(qian)(qian)單(dan)位(wei)與勞(lao)(lao)動(dong)者(zhe)簽(qian)訂(ding)勞(lao)(lao)動(dong)合(he)同。比如在勞(lao)(lao)動(dong)者(zhe)連續(xu)工作年限即將滿(man)10年將勞(lao)(lao)動(dong)者(zhe)轉給勞(lao)(lao)務(wu)派(pai)(pai)遣(qian)(qian)(qian)公(gong)司,再由勞(lao)(lao)務(wu)派(pai)(pai)遣(qian)(qian)(qian)公(gong)司派(pai)(pai)回本單(dan)位(wei),以規避無固定期(qi)限勞(lao)(lao)動(dong)合(he)同的(de)(de)簽(qian)訂(ding)。對于這種借用勞(lao)(lao)務(wu)派(pai)(pai)遣(qian)(qian)(qian)名義,企圖逃避法(fa)(fa)律責任的(de)(de)“逆(ni)向(xiang)派(pai)(pai)遣(qian)(qian)(qian)”,一旦(dan)發生勞(lao)(lao)動(dong)爭(zheng)議或者(zhe)糾紛,司法(fa)(fa)實(shi)踐(jian)中,一般認定該勞(lao)(lao)務(wu)派(pai)(pai)遣(qian)(qian)(qian)行為是(shi)無效的(de)(de),該企業不能擺脫其應當承擔的(de)(de)法(fa)(fa)律責任。
能否與(yu)(yu)勞(lao)動者(zhe)約定(ding)(ding)試用(yong)(yong)(yong)(yong)期(qi)?勞(lao)務派(pai)遣(qian)(qian)中,由于勞(lao)動者(zhe)不(bu)向派(pai)遣(qian)(qian)單(dan)位(wei)(wei)提供勞(lao)動,因此(ci),正(zheng)常情況(kuang)下,派(pai)遣(qian)(qian)單(dan)位(wei)(wei)在勞(lao)動者(zhe)的工(gong)(gong)作崗位(wei)(wei)尚未確定(ding)(ding)時(shi),不(bu)應單(dan)獨(du)與(yu)(yu)勞(lao)動者(zhe)約定(ding)(ding)試用(yong)(yong)(yong)(yong)期(qi)。如(ru)果用(yong)(yong)(yong)(yong)工(gong)(gong)單(dan)位(wei)(wei)以(yi)及(ji)工(gong)(gong)作崗位(wei)(wei)確定(ding)(ding)后(hou),派(pai)遣(qian)(qian)單(dan)位(wei)(wei)、用(yong)(yong)(yong)(yong)工(gong)(gong)單(dan)位(wei)(wei)和勞(lao)動者(zhe)可以(yi)根據(ju)法律的規(gui)定(ding)(ding)共同約定(ding)(ding)一個(ge)試用(yong)(yong)(yong)(yong)期(qi),如(ru)果試用(yong)(yong)(yong)(yong)期(qi)內被派(pai)遣(qian)(qian)員(yuan)工(gong)(gong)被用(yong)(yong)(yong)(yong)工(gong)(gong)單(dan)位(wei)(wei)證明不(bu)符合錄用(yong)(yong)(yong)(yong)條件(jian),用(yong)(yong)(yong)(yong)工(gong)(gong)單(dan)位(wei)(wei)可以(yi)將被派(pai)遣(qian)(qian)員(yuan)工(gong)(gong)退回派(pai)遣(qian)(qian)單(dan)位(wei)(wei)。
工傷(shang)(shang)責(ze)任由誰負擔?根據(ju)《工傷(shang)(shang)保險條例》的(de)有關規定,用人單位應按時(shi)交納工傷(shang)(shang)保險費。
依照該條(tiao)(tiao)例規定(ding)應(ying)當參加保(bao)(bao)險(xian)(xian)而未參加保(bao)(bao)險(xian)(xian)的用(yong)(yong)人單(dan)位職工(gong)(gong)(gong)發生(sheng)工(gong)(gong)(gong)傷(shang)的,由該用(yong)(yong)人單(dan)位按照本(ben)條(tiao)(tiao)例規定(ding)的工(gong)(gong)(gong)傷(shang)保(bao)(bao)險(xian)(xian)待遇項(xiang)目和標(biao)準(zhun)支付(fu)費用(yong)(yong)。所(suo)以(yi),派(pai)遣公司作(zuo)為用(yong)(yong)人單(dan)位,應(ying)為勞動者繳納工(gong)(gong)(gong)傷(shang)保(bao)(bao)險(xian)(xian)費,如果(guo)沒(mei)有的話,則應(ying)按《工(gong)(gong)(gong)傷(shang)保(bao)(bao)險(xian)(xian)條(tiao)(tiao)例》規定(ding)的工(gong)(gong)(gong)傷(shang)保(bao)(bao)險(xian)(xian)項(xiang)目和標(biao)準(zhun)支付(fu)各項(xiang)費用(yong)(yong)。而實際(ji)的用(yong)(yong)工(gong)(gong)(gong)單(dan)位,對工(gong)(gong)(gong)傷(shang)待遇的支付(fu)應(ying)承(cheng)擔(dan)連(lian)帶責任。
